JeOfferte.nl B.V. (hereinafter: "JeOfferte.nl") is the data controller within the meaning of the General Data Protection Regulation (EU 2016/679) ("GDPR") and the Dutch GDPR Implementation Act ("UAVG").

2. Applicability

This privacy statement applies to all processing of personal data relating to business relations, including professionals, suppliers, partners and other companies that use the JeOfferte.nl platform or provide services to JeOfferte.nl.

3. Categories of personal data

JeOfferte.nl processes business-related personal data, including but not limited to:

• Company name, Chamber of Commerce (KvK) number and VAT number;
• Name, position, telephone number and email address of contact persons;
• Usage and account information on the platform;
• Communication data (messages, complaints, support requests);
• Invoicing and payment information;
• Technical data (IP address, browser data, login sessions).

4. Purposes of processing

Personal data of business relations is processed for the following purposes:

1. Entering into and performing agreements with professionals or suppliers;
2. Managing accounts, leads and subscriptions;
3. Maintaining business communications and customer service;
4. Carrying out financial and administrative processes;
5. Carrying out marketing, service and relationship management activities on the basis of legitimate interest;
6. Safeguarding the security, continuity and quality of the services;
7. Complying with legal obligations, including statutory tax retention obligations.

5. Legal basis for processing

JeOfferte.nl processes personal data on the basis of the following legal grounds in accordance with Article 6 GDPR:

1. Processing is necessary for the performance of a contract;
2. Processing is necessary in order to comply with a legal obligation;
3. The processing is necessary for the legitimate interests of JeOfferte.nl, including relationship management, direct marketing to existing customers and improvement of services.

6. Disclosure to third parties

JeOfferte.nl only provides data to third parties where necessary for the performance of the agreement or to comply with statutory obligations. This may include:

• IT and hosting providers;
• Payment and accounting systems;
• CRM and marketing software (such as Mailchimp, Brevo, HubSpot or comparable systems);
• Analytics and security services (such as Google Analytics and Meta Business Suite);
• Legal and administrative service providers.

JeOfferte.nl enters into a data processing agreement with all processors in accordance with Article 28 GDPR.

7. Retention periods

Personal data of business contacts will not be retained longer than necessary for the purpose for which they were collected, unless a statutory obligation prescribes a longer retention period. Guidelines:

• Contract and invoicing data: 7 years (statutory tax retention obligation);
• Contact and communication data: 36 months after the last contact;
• Marketing data: until the data subject objects or the business relationship ends.

8. Security of personal data

JeOfferte.nl takes appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access or disclosure. Access is permitted only to authorised employees and processors who are bound by confidentiality obligations.

9. Rights of data subjects

Under the GDPR, data subjects have the following rights:

• Right of access to the processed data;
• The right to rectification or erasure of data;
• The right to restriction of processing;
• Right to object to processing, in particular in the case of direct marketing;
• Right to data portability.

10. International transfers
